General Terms and Conditions of the company

-Yorrxshire United GmbH – hereinafter: "Yorrx"

 

§1 Applicability to Consumers and Definitions

(1) The following General Terms and Conditions apply to all deliveries between Yorrxshire United GmbH, hereinafter referred to as "YORRX", and the respective buyer from the online shop www.callieway.com or generally for online and telephone inquiries and orders. 

(2) "CONSUMER" within the meaning of these terms and conditions is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business, or profession.

§2 Conclusion of a Contract

(1) In the event of a contract being concluded, the contract is made with

- The presentation of goods by YORRX on the internet or in other advertising materials does not constitute a legally binding contractual offer on our part, but is merely a non-binding invitation to the consumer to order goods.By ordering the desired goods, whether by filling out and submitting the order data on the internet, by email, fax, telephone, or by post, the CONSUMER makes a binding offer to conclude a purchase contract with YORRX.

- In the case of typographical, printing, or calculation errors on the website or other advertising materials, YORRX is not obliged to conclude a contract. If YORRX's supplier, despite contractual obligation, does not supply YORRX with the ordered goods, or if the stock level is incorrect or the item is no longer available in the corresponding quality, YORRX is not obliged to conclude a contract. In this case, the CONSUMER will be informed that the ordered product is not available.

§3 Prices, Shipping Costs, Payment, Due Date, and Collection

(1) The stated prices include statutory VAT and other price components. Any packaging and shipping costs are additional.
(2) The consumer has the option to pay in advance, via PayPal, or direct transfer. Cash payment is not possible!
(3) If the consumer has chosen payment in advance, they are obliged to pay the purchase price immediately after conclusion of the contract.

(4) Collection of the goods is possible after consultation with YORRX. Upon taking possession of the goods, the buyer checks the item for defects and thereby expressly waives all claims for damages and the right of return. Liability under the provisions of the Product Liability Act and warranty remain unaffected.

(5) Vouchers and discounts: Only one voucher can be redeemed per order or purchase. Vouchers cannot be accumulated. Unless clearly stated on the voucher, a voucher does not apply to already discounted goods. There is no legal claim to vouchers and discounts, and cash redemption is expressly excluded unless it is a monetarily purchased gift voucher. Vouchers expire at the latest 2 years after the date of issue, unless otherwise stated.

§4 Delivery, Defects, as well as Transport Damage and Transport Errors

(1) Unless otherwise clearly stated in the product description, all items offered by YORRX are ready for dispatch.
(2) Due to the payment agreement by advance payment, we do not ship the goods before confirmed receipt of payment by our bank or the respective payment system provider.

(3) Deliveries are possible worldwide, whereby the transport costs specified in the offer apply to specifically listed countries. Unless explicitly stated, transport costs to other countries must be requested from YORRX. All country-specific charges (e.g. import duties, etc.) in the CONSUMER's country must be covered by the CONSUMER.
(4) Delivery is made to the first house, apartment, or office door, provided that appropriate access and road conditions are available (otherwise, delivery is made to the nearest possible access point).

(5) If a product ordered by the CONSUMER is unexpectedly not available, YORRX is entitled to withdraw from the contract. In the event of non-availability, the CONSUMER will be informed by YORRX and all payments already made will be refunded to the CONSUMER without any claim to further services.

(6) If YORRX is i) in default of delivery; ii) makes partial or incomplete deliveries; iii) delivers incorrectly; or iiii) delivery becomes impossible, and intent or gross negligence on the part of YORRX is excluded, liability for damages (both direct and indirect) is excluded. General claims of the customer regarding rectification or rescission remain unaffected. The customer may, after setting a reasonable deadline for performance, declare withdrawal from the contract.

(7) In the event of delivery delays for reasons not attributable to YORRX (force majeure, fault of third parties, etc.), the deadline for performance will be extended appropriately. The customer will be informed. If the delay lasts longer than four weeks after conclusion of the contract, either party is entitled to withdraw from the contract and reclaim payments made without further claims.

(8) If delivery is not included in the product price as per the offer, delivery will be made for a flat shipping fee, the exact amount of which is specified separately upon delivery.
(9) If goods are delivered with obvious damage to the packaging or contents, the customer must immediately complain to the carrier/freight service and refuse acceptance of the goods. The customer must inform YORRX immediately about the defects or damage.

(10) Hidden defects must be reported to YORRX immediately after discovery.

§5 Retention of Title

We retain ownership of the goods until full payment of the purchase price has been made.

§6 Right of Return / Right of Withdrawal / Withdrawal Instructions

(1)        Right of return (according to §5g para. 2 KSchG):

 

As a CONSUMER, you have the right to return unused, originally packaged goods received without giving reasons within the period by returning the goods.The withdrawal period is one (1) month from the day on which you or a third party named by you, who is not the carrier, have taken possession of the goods. To exercise your right of withdrawal, you must inform us by means of a clear statement (e.g. a letter sent by post or email) of your decision to withdraw from this contract.

If the goods are collected in person or shipped to third countries (countries outside the European Economic Union (EU)), the right of return does not apply.

 

(2) Consequences of return (according to §5g para. 2 KSchG):


If you as a CONSUMER withdraw from this contract, we will refund all payments we have received from you for the value of the goods, i.e. minus any specified delivery costs, immediately and at the latest within fourteen days from the day on which we received notification of your withdrawal from this contract. For this refund, we will use the same means of payment that you used in the original transaction, unless expressly agreed otherwise with you; in no case will you be charged any fees for this refund. We may refuse the refund until we have received the goods back or until you have provided proof that you have returned the goods, whichever is earlier. You must return or hand over the goods to us immediately and in any event no later than fourteen days from the day on which you inform us of your withdrawal from this contract. If the product has already been used or is damaged, it is at YORRX's discretion to refund a reduced amount. The deadline is met if you send the goods before the period of fourteen days has expired. As a CONSUMER, you bear the direct costs of returning the goods.

 

 

§7 Warranty

(1) The CONSUMER's claims against YORRX in the event of defects are governed by the statutory provisions within the statutory periods, unless deviations arise from the following regulations. Obvious defects must be reported to YORRX in writing by the CONSUMER immediately, but no later than two weeks after receipt of the goods. No liability is accepted for consequential costs, such as if the defective product causes further damage.

(2) Warranty claims will be remedied by YORRX, depending on availability, by replacement, improvement, or price reduction.

(3) The CONSUMER has no claim against YORRX for damages caused by improper or non-contractual measures by the customer and/or the CONSUMER during storage and transport, installation, or use. Improper and non-contractual measures are determined in particular by the manufacturer's instructions.

(4) If the customer is an entrepreneur and the ordered service is for their business, their claims for defects expire one year after receipt of the goods.

(5) Warranty towards entrepreneurs

If the purchase between YORRX and the buyer is a commercial transaction, the buyer must inspect the delivered goods immediately for quality and quantity deviations and notify YORRX in writing of any recognizable defects within one week of receipt of the goods; otherwise, the assertion of warranty claims is excluded. Hidden defects must be reported to YORRX in writing within one week of discovery. Timely dispatch is sufficient to meet the deadline. In this case, the buyer bears the full burden of proof for all claim requirements, in particular for the defect itself, the time of discovery of the defect, and the timeliness of the notice of defect.

- In the event of defects, YORRX will, at its discretion, provide warranty by rectification or replacement delivery.

- The buyer's claims for defects expire after one year. This limitation period does not apply to claims for damages.

(6) Free additions to the goods or purchased item are explicitly excluded from the warranty.

 

§8  Liability

(1) YORRX is only liable for intent and gross negligence. It is the responsibility of the CONSUMER to ensure the security of their products and proper use.

(2) If an attributable breach of duty arises from simple negligence and a material contractual obligation is culpably breached, YORRX's liability for damages is limited to the foreseeable damage that typically occurs in comparable cases. Otherwise, liability is excluded.

(3) Liability under the provisions of the Product Liability Act remains unaffected.

 

§9  Data Protection

(1) The processing of personal data is based on the legal grounds specified in the General Data Protection Regulation (GDPR). Details of our data protection activities can be found in the privacy policy. You can find this on the respective website in the footer or we will send it to you upon request.

(2) The employees of YORRX are subject to the confidentiality obligations of the applicable laws. Routing and domain information must and may be passed on. The CONSUMER acknowledges that the use of their data, which became known in the course of their order, will be stored and processed by YORRX for the purposes of order processing, accounting, and customer records. Customer data is required and used by YORRX to comply with legal requirements and to process payments. Customer data will not be passed on to third parties unless this is absolutely necessary for contract processing or due to legal requirements.

 

§10 Contract Language and Law

(1) The only contract language available is German. Austrian law applies to the conclusion and execution of all contracts.

(2) If the buyer is a merchant, a legal entity under public law, or a special fund under public law, the exclusive place of jurisdiction for all disputes arising from this contract is the registered office of YORRX. The same applies if the CONSUMER has no general place of jurisdiction in Austria, or if the place of residence or usual abode is not known at the time the action is brought.

 (3) The application of the UN Convention on Contracts for the International Sale of Goods is excluded.
